The Federal High court sitting in Ado Ekiti on today ordered the Economic and Financial Crimes Commission to unban the Zenith Bank account of the Governor of Ekiti , Mr. Ayodele Peter Fayose with immediate effect.
The court insists that EFCC did not follow due process to freeze Fayose’s accounts hence the illegality cannot be allowed to continue.
The judegement also set aside an earlier order of a Federal High court, Lagos empowering the EFCC to freeze the said two accounts.
Delivering his judgement, the presiding Judge, Justice Taiwo Taiwo, said the rights of the governor had been unconstitutionally infringed upon, considering the circumstance of his office.
The judge said apart from the immunity been enjoyed by Governor Fayose, as stated in section 308 of the Nigerian constitution, it was wrong for the EFCC to have gone ahead to freeze his two accounts in apparent perpetuity without first investigating him or making him a party.
Justice Taiwo said instead of freezing Fayose’s account first, what the EFCC should have done was to investigate Fayose before going ahead to freeze his account if he was found guilty.
